Subsequent Injury Fund
The Subsequent Injuries Benefits Trust Fund (SIBTF) can provide additional workers’ compensation benefits to injured workers with pre-existing conditions, illnesses, or diseases.
Generally, there are three main requirements for a workers’ compensation case to qualify for additional compensation under SIBTF, all of which must be met:
Your current injury results in at least 35% unadjusted permanent disability. In some cases, this requirement may be lower.
Proof of pre-existing disability or impairment at the time of the current work injury.
Proof that your preexisting disability or impairment, plus the impairment from your current work injury, results in at least 70% unadjusted permanent disability.
For SIBTF qualification, preexisting conditions may come from any source, including prior work injuries, non-work injuries, illnesses, diseases, and developmental diseases, that existed up to the date of the new workplace injury may qualify.
